Fraud case: 80 000 documents await lawyers

Cape Town - The case docket against two men accused of embezzling more than R100-million in pension funds contains more than 80 000 documents, the Bellville Commercial Crimes Court has heard.

Businessman Sam Buthelezi and former South African Clothing and Textile Workers’ Union (Sactwu) consultant Richard Kawie appeared briefly in court on Friday.

They are accused of defrauding union members of their pension funds invested through Buthelezi’s asset management company, Trilinear, between March 2009 and February 2011.

Buthelezi’s lawyer, Rooshdeen Rudolph, said he had received the case against his client in the form of two electronic discs containing at least 80 000 pages.

Prosecutor Malini Govender has until August 30 to supply an index of the documents to the defence.

Rudolph and Ken Bredenkamp, for Kawie, must tell the court, after consulting with their clients, whether they would plead guilty to the charges.

The men are each out on bail of R500 000 with strict conditions. They must report to Sea Point police station every Monday, Wednesday and Saturday between 8am and 8pm and may not leave the Western Cape without permission from the investigating officer.

The men are also prohibited from entering any port of entry, Department of Home Affairs or embassy office. They also may not apply for any document at Home Affairs or any embassy, and may not contact State witnesses and Home Affairs employees. They must have a cellphone number on which they can be contacted at any time, and remain at home between 10pm and 5am every day until the matter is finalised.

Buthelezi and Kawie are due back in court on October 21.
